Article 2 - Definitions
- Entrepreneur: World Wide Wes, as described in Article 1.
- Consumer: Any natural person who is acting for purposes which are outside his or her trade, business, craft, or profession.
- Website: The webstore of the Entrepreneur, accessible via www.siblingspice.com.
- Agreement: Any distance contract concluded between the Entrepreneur and the Consumer via the Website for the purchase of products.
- Product: The goods, specifically hot sauce and related items, offered for sale on the Website.
Article 3 - Applicability
These General Terms & Conditions apply to every offer from the Entrepreneur and every Agreement concluded between the Entrepreneur and the Consumer. Before the Agreement is concluded, the text of these General Terms & Conditions will be made available to the Consumer electronically in such a way that the Consumer can easily store them. By placing an order, the Consumer explicitly agrees to these General Terms & Conditions.
Article 4 - The Offer
The Entrepreneur shall describe the offered Products as completely and accurately as possible. The description is sufficiently detailed to enable a proper assessment of the offer by the Consumer. Images used on the Website are a true representation of the offered Products. However, the Entrepreneur cannot guarantee that the displayed colors will exactly match the real colors of the Products. Obvious mistakes or errors in the offer, such as a clearly incorrect price, are not binding on the Entrepreneur. The Website will provide information on main characteristics of the Products, including ingredients and potential allergens.
Article 5 - The Agreement
The Agreement is concluded at the moment the Consumer accepts the offer by completing the entire ordering process on the Website, including the final payment. The Entrepreneur will immediately confirm receipt of the acceptance of the offer by electronic means (an order confirmation email). As long as the receipt of this acceptance has not been confirmed by the Entrepreneur, the Consumer may dissolve the Agreement.
Article 6 - Right of Withdrawal
In accordance with Dutch law regarding distance selling, consumers generally have a right of withdrawal for 14 days for many types of products.
EXCLUSION OF THE RIGHT OF WITHDRAWAL: The Entrepreneur explicitly informs the Consumer that the Products offered on the Website (hot sauce) are excluded from the right of withdrawal. This exclusion is based on Article 6:230p of the Dutch Civil Code, specifically for:
- Products that spoil quickly or have a limited shelf life (beperkte houdbaarheid).
- Sealed products which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Therefore, the Consumer cannot exercise the right of withdrawal for purchases of hot sauce made via the Website. All sales of hot sauce are final and non-returnable.
Article 7 - Pricing and Payment
All prices stated on the Website are in Euros (€), inclusive of the Dutch VAT (BTW). Shipping costs are calculated based on the delivery address provided by the Consumer:
- For delivery addresses within the municipality of Amsterdam, shipping is free of charge.
- For all delivery addresses within the Netherlands but outside of Amsterdam, a fixed shipping fee of €7.00 will be applied to the order.
- For all delivery addresses outside of the Netherlands, a fixed shipping fee of €12.00 will be applied to the order.
If the Consumer opts to have the order delivered to a DHL Pickup Point, a discount of €1.00 will be applied to the calculated shipping fee. This discount does not apply if the shipping is already free of charge (e.g., for deliveries within Amsterdam).
The applicable shipping costs and any discounts will be automatically calculated and clearly displayed as separate line items during the checkout process before the Agreement is concluded. The Consumer is obliged to pay for the order using one of the payment methods offered on the Website. The Consumer has the duty to immediately report any inaccuracies in payment details provided or stated to the Entrepreneur.
Article 8 - Delivery and Execution
The Entrepreneur will take the greatest possible care when receiving and executing orders for Products. The place of delivery is the address that the Consumer has made known to the Entrepreneur. The Entrepreneur will execute accepted orders with convenient speed but at the latest within 30 days, unless a different delivery period has been agreed upon. If delivery is delayed, the Consumer will be notified. The risk of damage to or loss of Products rests with the Entrepreneur until the moment of delivery to the Consumer, unless explicitly agreed otherwise.
Article 9 - Conformity and Warranty
The Entrepreneur guarantees that the Products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability, and the legal provisions existing on the date of the conclusion of the Agreement. This is the legal guarantee (wettelijke garantie). The "no return" policy in Article 6 does not affect the Consumer's statutory rights under this legal guarantee. If a Product is delivered damaged, spoiled, or is not the Product that was ordered, the Consumer must contact the Entrepreneur as soon as possible, but no later than 7 days after discovery. To make a claim under this article, the Consumer should contact the Entrepreneur via our contact page and provide the order number, a clear description of the issue, and photographic evidence. The Entrepreneur will then provide a suitable solution, such as a replacement or a refund.
Article 10 - Liability
The total liability of the Entrepreneur due to an attributable failure in the performance of the Agreement is limited to compensation of the amount of the purchase price for that specific Product. The liability of the Entrepreneur for indirect damage, including consequential loss, lost profit, or lost savings, is excluded. The limitations of liability in this article do not apply if the damage is due to intent or gross negligence (opzet of grove schuld) on the part of the Entrepreneur.
Article 11 - Intellectual Property
All intellectual property rights relating to the Website, including texts, logos, images, and design, are the property of the Entrepreneur. It is not permitted to copy, download, or otherwise use information from the Website without prior written permission from the Entrepreneur.
Article 12 - Complaints Procedure
The Entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure. Complaints about the performance of the Agreement must be submitted to the Entrepreneur within a reasonable time, fully and clearly described, after the Consumer has discovered the defects. Complaints submitted to the Entrepreneur will be answered within a period of 14 days from the date of receipt. Consumers can also use the ODR platform (Online Dispute Resolution) of the European Commission. This platform can be found at http://ec.europa.eu/odr.
Article 13 - Governing Law and Disputes
Agreements between the Entrepreneur and the Consumer to which these General Terms & Conditions apply are governed exclusively by Dutch law. Any disputes arising from the Agreement will be submitted to the competent court in the district where the Entrepreneur is established, without prejudice to the right of the Consumer to submit the dispute to the court that is competent by law.
